hello@mzansi.dev

These terms apply to mzansi.dev and explain how MZANSI ADVISORY (Pty) Ltd ("Mzansi", "we", "us" or "our") offers services. Please read them before using the website or requesting our services.

1. Using this website

By using this website, you agree to the terms that apply to your use. If you do not agree, please stop using it. If you act for a business, you must have authority to make commitments for it.

We provide artificial intelligence (AI) advice, part-time technology leadership, software development and system integration. This website provides general information about those services. Sending an enquiry does not place an order or commit either party to a paid project.

2. Service agreements

We agree the work in writing before it starts. The accepted proposal, statement of work or service agreement should describe what we will deliver and each party's responsibilities. It should also set out fees, payment dates, timing and support.

If a specific written agreement conflicts with these general terms, that agreement takes priority, subject to the law. We must agree changes to scope, price or delivery dates in writing. Website examples and estimated timelines do not guarantee results for a particular project.

3. Fees, cancellation and support

Your written agreement sets the fees, currency, taxes, deposits and payment dates. It should identify any subscriptions, usage charges or licences from other providers and who pays them.

Your service agreement and the law govern cancellation, termination, refunds, handover and support. These website terms do not require automatic renewal or impose cancellation fees or a general ban on refunds. Contact us promptly if you need to change or end the work.

4. Your responsibilities

You must provide accurate information and have permission to share the materials, data and system access needed for the work. You are responsible for decisions, feedback, approvals and external accounts as agreed.

Do not use the website or our services for unlawful activity or to infringe another person's rights. Do not send spam or malicious software, gain unauthorised access or interfere with the website's security or operation.

5. Intellectual property

The website's text, branding, graphics and other material belong to us or their respective owners. You may view the site and share links for lawful purposes. Other uses require the owner's permission unless the law allows them.

The service agreement must state who owns the project outputs and what licences apply. It must also cover existing tools, client materials and components from other providers. These website terms do not transfer ownership of your data or give us unrestricted use of your confidential material.

6. Confidentiality and personal information

Our Privacy Policy explains how we handle personal information from the website and business communications. The relevant confidentiality and service agreements should cover confidential project information and personal information controlled by clients.

Use the enquiry form for a general description of your needs. Agree a suitable way to share passwords, sensitive records or confidential data with us before sending them.

7. AI systems and third-party services

AI results can be incomplete, inaccurate or inconsistent. Projects involving AI should define tests and human review before the system makes important decisions or takes automated actions. We do not guarantee a particular business result unless we agree it in writing.

Other providers have their own terms, licences, availability and charges. Linking to or mentioning them does not make us responsible for their content or operation. Our service agreement and the law determine our duties when selecting, setting up or supporting their services.

8. Website availability and liability

We take reasonable care with this website but cannot promise uninterrupted access or that all information is accurate and current. We may update or suspend it for maintenance, security or business reasons. Please confirm details relevant to a proposed project with us.

Where the law allows, we exclude liability for indirect or consequential loss from using this free information website. The service agreement addresses liability for paid work.

We do not exclude liability for fraud, gross negligence or anything the law prevents us from excluding. We do not limit rights or remedies that the law prevents us from limiting. This includes protection under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and the Protection of Personal Information Act 4 of 2013 (POPIA).

9. South African law and disputes

South African law governs these terms. Disputes may be brought before a South African court with authority to hear them. This is subject to rights protected by law and any valid dispute-resolution terms in your service agreement.

Contact hello@mzansi.dev with any concern so we can try to resolve it. You may still seek urgent legal help, exercise your legal rights or approach a regulator or tribunal with authority to hear the matter.

10. Changes and general provisions

We may publish updated terms with a new date. Changes apply from that date onwards. They do not automatically change an existing written service agreement.

If a term cannot legally be enforced, the others continue to apply where the law allows. Delaying enforcement of a right does not, by itself, mean giving it up.

Send questions or notices about these terms to MZANSI ADVISORY (Pty) Ltd at the email or physical address above.
